TERMS APPLICABLE TO THE SALES OF PRODUCTS AND SERVICES

These terms of service are applicable to Customer's (you) purchase of any Photos, Prints and/or other Products through the Nate Johnson Photographic ("Studio") website ("Site"). Other than specifically provided in any separate written agreement between Customer and the photography studio, these Terms may not be altered, supplemented or amended by the use of any document, such as purchase order, and all sales are expressly conditioned upon Customer's agreement to these Terms. In the event of any conflict between these Terms and other provisions of the the Terms of Use, these Terms will control. Nate Johnson Photographic facilitates Client's purchase of Photos, Prints, Canvases, Albums and/or other Products through its relationship with the photography studio's vendors. If Customer purchases Photos, Prints, Canvases, Albums and/or other Products through the online store/Site, Customer acknowledges that the printing of any Photos or creates of other physical medium Products is performed by such vendors and the studio's role is to assist, facilitate and support such order process pursuant to these Terms of Service.  

Payment Terms

In order to purchase Products and Serves through the Nate Johnson Photographic Site, Customers are required to provide valid payment information as required by the Site. Studio may terminate Customer orders for Product or Services if unable to process Customer's payment information and an alternative form of payment is not provided upon Studio's request. Customer agrees to reimburse the Studio for any and all costs incurred in collecting amounts owed by Customer to Studio or Studio vendor, including, without limitation, attorney's fees and costs of collection agencies. 

Customer is responsible for any taxes that they are obligated to pay or that the Studio may collect from them in connection to the purchase of Products or Services. Studio may be required to collect and remit sales tax in connection with Customer's purchase. Any such taxes will be added to the purchase price and reflected on your invoice or receipt.

Photo Downloads and Shipping

If Customer purchases a Photo Download or if Photo Download was included in a contract, such download will be made available upon the Studio's receipt of valid payment. If Customer purchases Photo prints, Canvases, Albums or other physical medium Products, the Studio will use commercially reasonable efforts (and the Studio's vendors will use commercially reasonable efforts) to ship all orders for such Products within the estimated delivery time applicable to various methods of shipping available at the time order is placed. Studio is not responsible for any delays in shipping. Studio or Studio's vendors reserve the right to substitute another carrier of equal or lessor cost to deliver orders. All shipping charges are the Customer's responsibility. Shipping charges are include in the shopping cart and can be viewed prior to finalizing the order. The shipping charge shown during the checkout process is subject to verification and to correction or change without notice. If the actual shipping charge is more than the amount shown in the shopping cart, the Studio will contact Customer with the correct costs before processing the order allowing the Customer to cancel the order.
